I gave notice but the employer is acting strange

Common scenarios during the notice period — early release, refusal of leave, delayed payments. What is lawful and what is not.

In short: Once you have given notice under Art. 326 LC, your labor rights do not diminish. The employer owes: full salary for the period, compensation for unused leave (Art. 224 LC), and on early release — proportional compensation under Art. 220(2) LC. Payment deadline — day of termination.

Scenario 1. "Don't come in anymore, we'll pay you"

The employer can release you before the period expires — with written consent. In that case the employer owes:

  • Gross for the remainder of the notice as compensation under Art. 220(2) LC;
  • Compensation for unused leave (Art. 224 LC);
  • All unpaid amounts;
  • On the day of termination — no later.

Do not sign "by mutual consent" instead of the notice you already gave — it may void your right to Art. 220 compensation.

Scenario 2. "You can't take your leave"

The employer cannot without grounds refuse the use of accrued paid annual leave during the notice period. On refusal:

  • Send a written request to use the leave;
  • Keep a copy;
  • If the employer refuses — you will receive compensation under Art. 224 LC for unused leave on the day of termination;
  • Report the breach to ИА ГИТ.

Scenario 3. "We'll pay you later"

Art. 228(3) LC is explicit — compensation and unpaid salary must be paid no later than the day of termination. On delay:

  • Statutory interest is owed (BNB base rate + 10 percentage points per year);
  • Report to ИА ГИТ — fine on the employer of BGN 1,500–15,000;
  • Sue in the district court (3-year limitation).

Scenario 4. "I changed my mind"

Can you withdraw the notice? Before service — yes, easily. After service — only with the employer's written consent. The employer is not obliged to agree.

Scenario 5. "When is exactly my last working day?"

The notice period starts on the day after the day of service (Art. 326(4) LC). Compute it exactly with the notice-period calculator.

  unworked part of the notice period;

at least 2 working days before release.
